No Charges In Death Of EJ Bradford

An Alabama officer will not be charged in the fatal Thanksgiving Day shooting of 21 year old E.J. Bradford at a Birmingham area mall.  State Attorney General Steve Marshall announced that his investigation found the officer did not break the law and will not be charged in the death of Emantic “E.J.” Bradford Jr.  The facts of the case demonstrate that the officer “reasonably exercised his official powers, duties, or functions when he shot E. J. Bradford on the night of Nov. 22, 2018,” the report states.

Bradford’s shooting happened as officers were responding to a report of gunfire at the Riverchase Galleria in Hoover.  At 9:52 pm on November 22, 2018, an altercation involving four people occurred near the Footaction and JCPenney stores on the second level of the mall.  One of the men, Erron Brown, reportedly drew a weapon and shot 18-year-old Brian Wilson twice before fleeing the area.  Stray gunfire also hit a 12-year-oil Molly Davis.

According to the Alabama State Attorney General’s report, approximately five seconds after the shooting, two officers from the Hoover Police Department approached Bradford, who was “running toward the initial shooter and victim with a firearm visibly in hand.”  One of the officers fired shots at Bradford from behind, striking him 3 times in the head, neck and lower back.  The attorney general’s report says the officer mistakenly believed Bradford had fired the earlier shots and was justified in shooting him. The officer saw Bradford running toward the shooting scene with a gun and believed he was trying to kill the shooting victim, according to the report.

Police initially described Bradford as the gunman and said officers acted heroically to “take out the threat,” but later corrected themselves and identified Erron Brown as the alleged shooter.  Brown, 20, was arrested in Georgia a week later and charged in the shooting of Brian Wilson and Molly Davis.  The attorney general, whose office took over the investigation from the local district attorney in Hoover, also released surveillance video and other documents from the investigation.

E.J. Bradford had enlisted in the army in 2017 and completed basic training, but was administratively separated in August 2018.   He was a licensed gun owner and was reportedly attempting to protect the mall patrons when he was shot.  Bradford’s killing sparked weeks of protest last year and protests erupted again after the announcement that the officer would not be charged.  Bradford’s father called the attorney general “a coward” for the report’s finding.  “My son was murdered. And you think I’m going to let it go?,” Emantic Sr. told reporters Tuesday. “That was a homicide … You killed my son. You are a coward. You’re a coward too, Steve Marshall.”

Benjamin Crump, an attorney for the Bradford family, said officers stated in the attorney general’s report that they did not give Bradford any verbal warning.  “We don’t have any evidence whatsoever that E.J. ever knew the police officers were there whatsoever.  E.J. went to his grave not knowing who shot him three times in his back.”  Crump said that race played a role in Bradford’s death and that a civil lawsuit claiming wrongful death will be filed.

Two Men Admit Role in Minnesota Mosque Attack

Two members of an Illinois militia group admitted to bombing a Bloomington mosque in 2017 in a bid to terrorize Muslims into leaving the United States.  Michael McWhorter and Joe Morris rented a truck and drove more than 500 miles to bomb a Minnesota mosque.  Both men pled guilty to five counts related to the mosque attack, as well as the attempted bombing of an Illinois abortion clinic and other crimes.  A third suspect, 47 year old, Michael Hari, whom prosecutors said directed the bombing, remains in federal custody.

Hari is a former sheriff’s deputy from Illinois who runs a security company and submitted a bid to build President Trump’s border wall.  The plea agreements portray Hari as the ringleader of a militia group called the White Rabbits, which included Hari, McWhorter, Morris and at least five other people. Hari’s trial is set for July.  The plea agreements say the men targeted the mosque to interfere with the free exercise of religion by Muslims and to let Muslims know they were not welcome in the United States.

According to the plea agreements, the men were headed toward Minnesota when Hari told McWhorter and Morris that he had a pipe bomb in the vehicle and they were going to bomb a mosque.  When the three men arrived at Dar al-Farooq Islamic Center in Bloomington on Aug. 5, 2017, Hari gave Morris a sledgehammer and told him to break a window.  McWhorter then lit the fuse on the pipe bomb and threw it inside.   Morris then threw the gasoline mixture inside, causing an explosion, fire and extensive damage.  No one was injured in the attack, which happened just as morning prayers were about to begin, terrifying members of the local Muslim community.

Hari allegedly picked Dar al-Farooq because it was far enough away from the White Rabbits’ central Illinois hometown that he thought they wouldn’t be suspected. He also allegedly believed it was a focal point for terror recruiting, a claim that law enforcement has not substantiated.    Morris’ attorney, Robert Richman, said Morris merely followed the lead of Hari, a man he’d known as a father figure since he was 9.  “Hari essentially weaponized Joe Morris,” Richman said.

McWhorter and Morris also pleaded guilty to their roles in a failed attack on a Champaign, Illinois, abortion clinic in November 2017. A pipe bomb that Morris said he and Hari threw into the clinic did not explode.  Court documents also state that Hari, McWhorter, Morris and others also participated in an armed home invasion in Ambia, Indiana, and the armed robberies or attempted armed robberies of two Walmart stores in Illinois.  Morris and McWhorter also admitted to attempting to extort Canadian National Railway by threatening to damage tracks if the railroad didn’t pay them money.  Morris and McWhorter could each face at least 35 years in prison.  A fourth man, Ellis Mack of Clarence, already pled guilty to two counts in Illinois and is scheduled to be sentenced in April.

James Fields Sentenced For Unite The Right Violence

James A. Fields Jr., the neo-Nazi who rammed his car into a group of counter-protesters at the Unite The Right rally on August 12, 2017, has been sentenced to life for first-degree murder; 70 years for each of five counts of aggravated malicious wounding; 20 years for each of three counts of malicious wounding; and nine years for leaving the scene of a fatal crash.  The jurors were instructed that the sentences would be “presumed to be consecutive” unless they recommended that the terms be served simultaneously. Fields’s overall sentence: life plus 419 years and $480,000 in fines.

The jury of seven women and five men convicted Fields of the 10 offenses in a Charlottesville Circuit Court.  In Virginia, trial juries determine what penalties should be handed out within sentencing ranges dictated by law.  Judge Richard E. Moore, who said he will formally sentence Fields on March 29th, can impose a lesser punishment than the jurors called for but is not allowed to increase the sentences.

During the trial, Fields psychiatric disorders dating to early childhood were detailed in court by a mental-health expert.  Psychologist Daniel Murrie testified that Fields was diagnosed with bipolar disorder at the age of 6 and has been prone to angry, sometimes violent outbursts since before he could walk and was “expelled from preschool” because of his volatile behavior.  As an adolescent, he was found to have schizoid personality disorder and was housed in psychiatric facilities for three stretches before his 15th birthday.

Murrie testified that Fields did not meet Virginia’s legal definition for not guilty by reason of insanity.  To be acquitted on the basis of insanity, a defendant must show that he did not understand the difference between right and wrong at the time of the offense or was mentally unable to control his actions.  Fields did not deny that he intentionally accelerated his Dodge Challenger into a group of counter-protesters, killing Heather Heyer and injuring 19 others.  His lawyers contended that he was afraid for his safety and acted to protect himself but jurors rejected that argument and issued 10 guilty verdicts.

Several of the injured victims, testified at Fields’s trial and sentencing hearing, described lasting physical wounds, psychological anguish and dire financial distress.  They described their injuries including shattered bones and debilitating nerve damage that they may never fully recover from.  They spoke of nightmares, social isolation caused by post-traumatic stress disorder and crushing medical bills from surgeries that have depleted their insurance and could burden them far into the future.

Fields faces a separate federal trial for alleged hate crimes related to the incident, including one offense that carries a possible death sentence. No trial date has been set and the Justice Department has not said whether it will seek capital punishment.

Three Indiana Siblings Killed At Bus Stop

A 24-year-old woman is facing 3 counts of reckless homicide and one misdemeanor count of disregarding a stop sign and causing injury after the pickup truck she was driving struck and killed three siblings who were crossing the road to get to their school bus in rural Rochester, Indiana.  Six-year-old twin brothers Xzavier Ingle and Mason Ingle, and their 9-year-old sister, Alivia Stahl, died at the scene Tuesday morning.  The children’s classmate and neighbor, 11-year-old Maverik Lowe, was also hit.  He was airlifted to the hospital and remains hospitalized in critical condition.  The children were crossing State Route 25 to get to their school bus when they were hit at about 7:15 a.m. in front of the Meiser mobile home park where they lived.

The Tippecanoe Valley School Corp. bus had stopped on the two lane road, lowered its stop-arm and had the emergency lighting activated just before the northbound Toyota Tacoma pickup truck slammed into the children as they crossed the southbound lane.  Alyssa L. Shepherd, of Rochester, was arrested at her workplace, was charged and released on a $15,000 bond.  Shepard told an Indiana State Police detective that she saw flashing emergency lights on the rural highway but didn’t realize it was a school bus picking up the children until it was too late.  By the time she realized a bus was stopped, the children were already in front of her vehicle.  Their father rushed out of their home and identified them after police arrived to investigate, officials said.  State Police Detective Michelle Jumper testified at a probable cause hearing into charges against Alyssa Shepherd, the bus driver told investigators he saw the oncoming truck’s headlights. The bus driver stated that because the truck was far back and had plenty of time to slow, the driver waved to the children, telling them to cross.  The bus driver honked the horn when it was clear the truck wasn’t stopping.  Jumper testified that Shepherd told her she typically did not drive on the route where the crash occurred and that she had three children in the back seat of her truck when she allegedly struck and killed the three siblings.

A witness driving behind Shepherd said she and Shepherd were traveling 45 mph. The witness said the truck’s headlights illuminated the children as they were crossing the road and she said she started to freak out as she realized ‘I’m slowing down, but that truck in front of me is not slowing.”  Shepherd remained at the scene after the crash, cooperating with investigators. She was given a blood test as is standard in all fatal crashes, but police said they do not think alcohol or drugs were a factor.  Shepard who works as children’s director at Faith Outreach, a Foursquare Gospel Church in Rochester then went to work to pray.

Parents who live in the mobile home park had previously asked the Tippecanoe Valley School Corporation to change the bus route so the children didn’t have to cross State Route 25 to catch the bus. Parents complained that it was dangerous for children to cross a highway where vehicles routinely travel at 50 to 60 mph.  Elgin Ingle, the uncle of the children who died said “There’s plenty of room for the school bus to pull into the mobile home park and pick up these kids.  This school has been warned that this is an issue.  My brother is torn apart, he didn’t lose one kid, he lost all his kids,” Ingle said. “How do you tell your little brother it’ll get better? You can’t. My brother, the most loving man in the world and the best father I’ve ever known, now is a father to no one.”  Blaine Conley, superintendent of the Tippecanoe Valley School Corporation, released a statement that stating that the bus stop will be relocated from State Road 25 into the mobile home park where the children lived.

21 Killed In School Shooting In Russia

Russian officials say the gunmen who killed 21 people and wounded 53 more before killing himself at a vocational school in Crimea was an 18 year old student of the school.  The shooter, identified as Vladislav Roslyakov, described as a shy loner, also set off an explosive device.  He committed suicide in the library after the assault at Kerch Polytechnic College.  Officials are still investigating a motive in the attack which is the deadliest instance of school violence in the region since the 2004 Beslan terror attack, which killed 333 people, most of them children.

At first, officials reported a gas explosion at the school but later said an explosive device had ripped through the cafeteria during lunchtime in a suspected terrorist attack.  Eventually, the attack was classified as a mass murder attack at the school carried out by one person.  The Investigative Committee said the homemade explosive device rigged with shrapnel went off in the school lunchroom and a second explosive device was later found and destroyed.

Guns are tightly restricted in Russia. Civilians can own only hunting rifles and smooth-bore shotguns and must undergo significant background checks.  Local officials said Roslyakov had only recently received a permit to own a shotgun which he bought on September 8th.    Officials say Roslyakov bought 150 rounds of ammunition at a gun shop on October 13.  Just four days later on October 17th, he entered the school grounds at about 11:46 a.m. and began his attack.  Several witnesses described the gunman walking up and down the halls at Kerch Polytechnic College and firing randomly at classmates and teachers. He also fired at computer monitors, locked doors and fire extinguishers.  A survivor of the attack said the shooting lasted about 15 minutes.

Security footage at the school shows Roslyakov enter the technical college carrying a sports bag and bypassing security.  He then entered the school’s lunchroom with a rucksack and leaving without it.  The footage captures him going up to the school’s first floor empty-handed just before a fire ball and a massive explosion blows out windows and doors on the ground floor.  Roslyakov is then shown walking towards a female teacher in a corridor and gunning her down, before shooting an approaching student.  A security camera image carried by Russian media showed Roslyakov, calmly walking down the stairs of the school with the shotgun in his gloved hand while wearing a T-shirt emblazoned with the word “Hate.”

A video taken by an unknown survivor of the attack shows a terrified group of students and staff running through a hallway as gunshots and screaming can be heard nearby.  The group talk in whispers as they search for safety, not knowing where the gunmen is.  The video shows them briefly in a classroom and then another hallway.  They approach a stairwell and see a body on the stairs below before turning back down the hall and down another stairwell.  Terrified, they cautiously look down the stairs before making a run through a doorway and to an outside exit.

If you’re thinking some details in this story sound very familiar you are correct.  His outfit resembled that of Eric Harris, one of the perpetrators of the 1999 Columbine High School massacre.  The Columbine attackers also tried but ultimately failed to detonate an explosive device in the cafeteria.  Similar to Columbine, Roslyakov also retreated to the school library to commit suicide after the attack.  A friend of the shooter said he had an interest in the Columbine school shooting in the US.  Also leading to speculation that the massacre was a copycat crime is the fact that some Russian news outlets have reported that Roslyakov belonged to a fan club on social media for the columbine shooters.  Russian news outlets have dubbed the shooting the “Russian Columbine,” because of the similarities.

Officer Found Guilty In Laquan McDonald Shooting

Chicago Police Officer Jason Van Dyke, 40, was convicted of second degree murder in the 2014 shooting death of 17 year old Laquan McDonald.  Van Dyke is the first Chicago officer to be charged with murder for an on-duty shooting in about 50 years. Second-degree murder usually carries a sentence of less than 20 years, especially for someone with no criminal history but probation is also an option. Van Dyke was also convicted of 16 counts of aggravated battery — one for each bullet.

The second-degree verdict reflected the jury’s finding that Van Dyke believed his life was in danger but that the belief was unreasonable. The jury also had the option of first degree-murder, which required finding that the shooting was unnecessary and unreasonable.  Legal experts say Van Dyke will likely be sentenced to no more than 6 years but that because he is an officer, it will likely be in isolation.

The verdict was the latest chapter in a story that shook Chicago residents soon after a judge ordered the release of the video in November 2015.  Protests erupted and continued, demanding accountability for the shooting.  The city’s police superintendent and the county’s top prosecutor both lost their jobs — one fired by the mayor and the other ousted by voters. It also led to a Justice Department investigation that found a “pervasive cover-up culture” and prompted plans for far-reaching police reforms.

The city had been preparing for possible demonstrations in a case that already sparked protests with many downtown businesses and City Hall closing early in anticipation of protests.  Groups of demonstrators took to the streets for several hours after the verdict, chanting, “The people united will never be defeated,” and “Sixteen shots and a cover up.”

Prosecutors in Van Dyke’s trial called on multiple officers who were there that night in an effort to penetrate the “blue wall of silence” long associated with the city’s police force and other law enforcement agencies across the country.  Three officers, including Van Dyke’s partner, have been charged with conspiring to cover up and lie about what happened to protect Van Dyke. They have all pleaded not guilty.

According to testimony, on the night of the shooting, officers were waiting for someone with a stun gun to use on the teenager when Van Dyke arrived.  Former Police Officer Joseph Walsh, Van Dyke’s partner the night of the shooting, testified that Van Dyke said to him “Oh my God, we’re going to have to shoot that guy,” before arriving at the scene.  Van Dyke was on scene for less than 30 seconds before opening fire and the first shot he fired was 6 seconds after he exited his patrol car.

The first responding officer said that he did not see the need to use force and none of the at least eight other officers on the scene fired their weapons.  Video of the shooting shows that Officer Van Dyke was advancing on McDonald, while McDonald was walking away from him when the first shot was fired.  McDonald was shot 16 times in 14–15 seconds and 9 of those shots hit his back as he lay on the ground.  Toxicology reports later revealed that McDonald had PCP in his blood and urine.

Assistant special prosecutor Jody Gleason told the jury that Van Dyke contemplated shooting McDonald before he even encountered the young man, referring to testimony about what Van Dyke told his partner before arriving at the scene.  “It wasn’t the knife in Laquan’s hand that made the defendant kill him that night. It was his indifference to the value of Laquan’s life.”   Van Dyke was taken into custody moments after the verdict was read.  He is scheduled for a sentencing hearing on October 31.

Death Toll In Laos Dam Collapse Could Be Far Higher Than Initial Reports

Aid groups say the toll from the collapse of a billion-dollar hydroelectric dam in Lao’s is far higher than the official figure of 27 dead and 131 missing. Despite a government ban on foreign media covering the disaster, the BBC reports the death toll could be closer to 300. Another 3,000 people are still stranded in homes surrounded by floodwaters and over 6,000 people have been displaced.  The dam collapse occurred around 8 p.m. on July 23rd and caused immediate flash flooding through the villages of Yai Thae, Hinlad, Ban Mai, Thasengchan, Tha Hin, and Samong, all in Sanamxay district.  Homes, roads and bridges were swept away.

The disaster has revived the debate about plans by the Laos government to boost the economy by building dozens of dams to export hydroelectricity to neighboring countries.  The South Korean company that is the main builder of the hydroelectric project has admitted that it knew the dam was deteriorating a day before it failed but the reason for the collapse remains unclear.  There are conflicting reports on when damages to the dam were first noticed, raising more questions on whether the order to evacuate villagers from their homes should have been issued earlier.  The portion of the dam that collapsed was reported to be a saddle dam—its official name was “Saddle ‘D’, an auxiliary structure used to hold water beyond what is held by the main dam”.

Emergency teams in southern Laos are continuing to search for survivors following the collapse of a dam, which released five billion cubic meters of water.  As floodwaters in began to recede, official sources said eight bodies had been recovered, while an official has suggested more than 1,100 people may still be unaccounted for.  Homes were swept away and farmland submerged when an auxiliary dam at the Xe Pian Xe Namnoy hydroelectric project collapsed.

An overwhelming amount of mud left behind is hampering search operations.  Some areas are inaccessible by boat, with helicopter flights being the only way to reach some communities.  Rescue efforts are further complicated by the fact that the area is densely forested with no mobile-phone coverage.  Roads that previously existed were washed away in the floods and thousands of people who fled their homes are packed into makeshift shelters.

Officials in northern Cambodia have ordered the evacuation of 25,000 people downriver of the collapsed dam, due to heavy flooding and rising water levels.  The Prime Minister of Laos, Thongloun Sisoulith, suspended his immediate meetings and travelled in person to the site.  Sisoulith also called in both the police and the army, declaring the area a disaster zone.  The local government requested emergency aid from neighboring communities.  The neighboring countries of China, Malaysia, Philippines, Singapore, Thailand and Vietnam have offered to provide any assistance needed by Laos.
