Bill Cosby Sentenced

Comedian Bill Cosby was sentenced to three to 10 years in a state prison for drugging and sexually assaulting Andrea Constand at his home 14 years ago.  Cosby, 81, will be eligible for parole in three years and could be released from prison and allowed to serve out the rest of his 10-year sentence under supervision in the community.

Judge Steven O’Neill said the evidence that Cosby planned the drugging and sexual assault of his victim was “overwhelming,” based on Cosby’s own words in a civil deposition.  In the deposition, provided the year after the alleged assault, as Constand pursued a civil suit against him, Cosby admitted that he procured Quaaludes for women he wanted to have sex.  Cosby also admitted that he asked a modeling agent to connect him with young women who were new in town and “financially not doing well.  Judge Steven O’Neill ruled that the 2005 testimony could be presented to the jury in his criminal trial.

Months after his depositions, Cosby settled the case with Constand and the accusations quickly faded. In October 2014, a Philadelphia magazine reporter at a Hannibal Buress show uploaded a clip of the comedian calling Bill Cosby a rapist and commenting on his Teflon image.  The clip went viral and soon after many accusers stepped forward.  More than 60 women have accused Cosby of sexual assault or harassment, stretching back to the 1960’s but Constand’s case was the only one that led to criminal charges against the comedian.  During interviews, all of the women gave similar accounts of blacking out after having a drink supplied by Cosby and later waking up during or after a sexual assault.  Most said they stayed quiet because they never thought anyone would believe them since Cosby was wealthy and at the height of his career.

On April 26, he was found guilty of three counts of aggravated indecent assault for the 2004 drugging and sexual assault of Andrea Constand. Each charge carries a maximum of 10 years in prison but Judge Steven O’Neill said that the charges had been merged into one because they all stem from the same event.  Constand, a 31-year-old Temple women’s basketball official he was mentoring at the time of the assault.  She testified in detail at the trial about losing control of her limbs after taking pills given to her by Cosby, who served on Temple’s board of trustees and was the public face of the university. The pills, Constand said, left her unable to stop him from violating her at his suburban Philadelphia estate.

At the sentencing hearing, O’Neill aid, “No one is above the law, and no one should be treated differently or disproportionally.”  “This was a serious crime,” O’Neill added. “Mr. Cosby, this has all circled back to you. The day has come, the time has come.”  Cosby was also ordered to pay a fine of $25,000 plus the costs of prosecution — a total of $43,611 — as part of the sentence.  Cosby’s attorneys have repeatedly said they plan to file an appeal in the criminal case.

A Pennsylvania court found comedian Bill Cosby guilty of three counts of aggravated indecent assault for drugging and sexually assaulting Andrea Constand at his home in 2004. The 80 year old comedian is facing 30 years in prison and his sentencing hearing is scheduled for this summer. Though he faces a maximum of 30 years in prison, Montgomery County District Attorney Kevin Steele indicated he would not press for that sentence.

Legal experts believe that it is unlikely Cosby will ever be incarcerated and a judge will probably sentence him to home refinement due to his poor health. Legal analyst Areva Martin said the judge’s rulings so far suggest he will give Cosby a much reduced sentence. “I think the fact that the judge yesterday allowed him to walk out of that courtroom, did not remand him immediately to jail, gives us a sense about what this judge is likely to do when he gets to the sentencing hearing,” she said.

Judges can take any number of mitigating factors into consideration when issuing a sentence, she explained. “He will be able to take into consideration Cosby’s age, the status of his health, the philanthropic work that he’s done over the last several decades, the fact that this is his first criminal conviction — all of those will be factors that the judge can take into consideration when sentencing him.”

Constand is the former director of operations for the women’s basketball team at Temple University where Cosby was a trustee and one of about 60 women who have accused him of sexual assaults dating back decades. Constand’s case is the only criminal case stemming from the dozens of accusations of sexual misconduct — all of which the comedian/actor denies. She says she was “paralyzed” by pills he gave her while he claimed it was just Benadryl and that the encounter was consensual.

He maintains that the sexual encounters were consensual but has admitted to giving them drugs prior to the encounters. In January 2005, in a civil suit Constand filed, she accused Cosby of giving her pills, groping her and assaulting her. Thirteen other women relayed similar claims in court papers and agreed to testify to these claims but the case was settled out of court in 2006. Many of the women gave similar accounts of what happened to them but didn’t come forward for years because they felt no one would believe them over the well-loved actor/comedian.
That changed in October 2014 when comedian Hannibal Burress made fun of Cosby during a stand-up comedy bit and called him a rapist. “People think I’m making it up. I’m like ‘Bill Cosby has a lot of rape allegations,’ (they reply back) ‘No, you do’….That sh*t is upsetting, if you didn’t know about it trust me. Google ‘Bill Cosby rape.

Then in November 2014, Barbara Bowman wrote a Washington Post essay that immediately went viral in which she discussed being raped by Cosby and questioned why it took so long for people to believe her. For months after that essay, dozens of women came forward with similar accusations occurring as far back as the 1960’s.

Cosby Case Ends In Mistrial

Bill Cosby’s sexual assault trial has ended in a mistrial after jurors remained deadlocked on all counts after 52 hours of deliberation.  Cosby faced three counts of aggravated indecent assault. Andrea Constand has accused Cosby of drugging and sexually assaulting her at his home in 2004.  Constand is the former director of operations for the women’s basketball team at Temple University where Cosby was a trustee.

Constand is one of about 60 women who have accused Cosby of sexual assaults dating back decades.  It’s the only criminal case stemming from dozens of accusations of sexual misconduct — all of which the comedian/actor denies.  She says she was “paralyzed” by pills he gave her while he claimed it was just Benadryl and that the encounter was consensual.

Cosby did not take the stand, but his lawyers have maintained the physical contact was mutual and raised questions as to why Constand kept in phone contact with Cosby after the alleged incident.  They also questioned why she did not report it for a year. Prosecutors declined to charge Cosby in 2004 but reopened the case after the scandal erupted two and

a half years ago.

The jurors were chosen in the Pittsburgh area and bussed in to Philadelphia for the trial.  After six days of testimony, the jury of seven men and five women began deliberations.  They were soon deadlocked but continued to deliberate, reviewing reams of testimony.  After 52 hours of deliberations, Montgomery County Judge Steven O’Neill accepted a defense motion for a mistrial.

Montgomery County District Attorney Kevin Steele immediately announced that he plans to retry the case and ordered that Cosby can remain free on $1 million bail he posted when he was first charged.  Steele later told reporters that there “was no pause or hesitation” in deciding to retry the case and that “we had a significant amount of evidence … now we have to prove (the case) beyond a reasonable doubt.”  Prosecutors will retry him on three counts of aggravated indecent assault, a charge that carries 10 years in prison.

Outside the courthouse, lawyer Gloria Allred, who represents some of the women who have accused Cosby of sexual misconduct, said that “round two may be just around the corner, and this time, justice may prevail.”  She commended her client Kelly Johnson, the only other accuser allowed to testify at the trial, and thanked all the accusers who have spoken out.  Several of Cosby’s accusers have been attending the trial.
